General terms of use for the FOKUS website.

§ 1 Scope

These general terms of use (hereinafter „Terms“) govern the use of the website of FOKUS Clan GmbH at the domain fokusclan.de and its subpages.

The operator of the website is FOKUS Clan GmbH, Hohenzollernring 2–10, 50672 Köln (full details in the legal notice).

By using the website you accept these Terms. Anyone who does not agree with these terms is asked not to use the website.

§ 2 Offer and services

The website is the informational presence of the FOKUS esports organisation. Among other things, it provides the following content:

  • Information about the FOKUS teams (VALORANT, Counter-Strike 2, EA FC, Fortnite)
  • Creator and player profiles
  • Media content as well as a social feed
  • Information about partners and sponsors
  • Ways to get in touch

The operator reserves the right to change, expand, restrict or discontinue the offer at any time without notice.

§ 3 Copyright and usage rights

All content published on this website (texts, images, graphics, videos, logos, trademarks, etc.) is protected by copyright and is owned by FOKUS or the respective rights holders.

The reproduction, editing, distribution and any kind of use beyond the limits of copyright law require the prior written consent of the respective rights holder. Downloads and copies of this page are permitted only for private, non commercial use. The following in particular is not permitted:

  • the commercial use of content without express permission
  • the systematic extraction of content by automated means (scraping)
  • the use of logos, trademarks or image material for your own purposes without permission
  • passing on or publishing content without citing the source

§ 4 User obligations and conduct

You undertake to use the website exclusively for lawful purposes and not to carry out any actions that:

  • violate applicable law or these Terms
  • infringe the rights of third parties (in particular personal rights and copyrights)
  • impair or endanger the operation of the website
  • introduce malware, viruses or other harmful technologies
  • overload or attack the infrastructure of the website

The operator reserves the right, in the event of violations, to block access to the website and to take legal action.

§ 5 Liability and warranty

The content of this website is created with the greatest possible care. The operator, however, accepts no guarantee for the accuracy, completeness and timeliness of the content provided.

Liability for damages arising from the use of the website is excluded, unless they are based on intentional or grossly negligent conduct by the operator or unless any essential contractual obligations (cardinal obligations) have been violated.

The website may contain links to external third party websites. The operator has no influence on their content and therefore accepts no liability for their accuracy or timeliness. The availability of the website is not guaranteed; the operator is entitled to suspend operation temporarily or permanently, even without prior notice.

§ 6 Social media presence

FOKUS maintains a presence on external social media platforms (for example Instagram, YouTube, TikTok). The respective terms and privacy policies of the platform operators apply to these platforms. The operator accepts no responsibility for content published there by third parties.

§ 7 Changes to the terms of use

The operator reserves the right to change these terms of use at any time. The current version is always available on the website. Continued use of the website after the publication of changed terms of use is deemed acceptance of the changed terms.

§ 8 Applicable law and place of jurisdiction

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Insofar as you are a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is the registered office of the operator.

§ 9 Severability clause

Should individual provisions of these terms of use be or become invalid or unenforceable, the validity of the remaining provisions remains unaffected. The invalid provision is deemed replaced by a valid provision that comes closest to the economic purpose of the invalid provision.
